In a tragic example of street justice, a Texas man has been charged with murdering a suspected drunk driver whose car hit and killed his two young sons.

David Barajas Sr. and his two sons -- 12-year-old David Barajas Jr. and 11-year-old Caleb -- were helping their father push their broken-down pickup truck back in December when 20-year-old Jose Banda allegedly drove his car into them near the family's Houston-area house.

Witnesses heard gunshots shortly after 911 was called about the accident and authorities found Banda, who died later at a hospital, with a gunshot wound in his head. Witnesses saw Barajas next to Banda's vehicle when the shots were fired.
